Wild Imports – Master Terms, Warranty, Returns & Liability Policy

1. General Terms

These Terms apply to all boats, trailers, machinery, equipment and accessories sold by Wild Imports. By purchasing, collecting, accepting delivery of, or using goods supplied by Wild Imports, the purchaser agrees to be bound by these Terms.
 

2. Pricing, Deposits & Payment

All prices are in AUD and include GST unless stated otherwise. Deposits may be required to secure stock or special orders. Deposits on custom or special-order items are non-refundable once procurement or production has commenced. Full cleared payment is required before delivery or collection unless agreed in writing.
 

3. Retention of Title

Title to goods remains with Wild Imports until full payment has been received and cleared. Wild Imports reserves the right to recover goods where payment is outstanding and may register its interest on the PPSR if applicable.
 

4. Risk, Delivery & Inspection

Risk passes to the purchaser upon collection or delivery. The purchaser must inspect goods immediately and notify Wild Imports in writing within 48 hours of any transit damage or discrepancy.
 

5. Warranty Coverage

Products are supplied with manufacturer warranties covering defects in materials and workmanship for the stated warranty period. Warranty remedies are limited to repair, replacement, or supply of parts at the discretion of Wild Imports or the manufacturer.
 

6. Warranty Exclusions

Warranty does not cover misuse, abuse, neglect, improper operation, overloading or poor maintenance; corrosion from salt, chemicals or environmental exposure; normal wear and tear; cosmetic damage including scratches, dents, paint chips, fading, oxidation, surface rust, powder-coating or galvanised finish damage; upholstery wear and tear, weathering or sun damage; or unauthorised modifications or repairs. For machinery and equipment, excluded wear items include: tyres, rubber tracks, belts, chains and sprockets, bearings, brake components, hydraulic hoses or any item subject to normal wear and tear, batteries, filters and lubricants. These items are considered consumables unless a manufacturing defect is proven.
 

7. Boats – Structural Warranty Limitations

Hull structural warranties apply only to structural defects in the hull itself and exclude paint, coatings, fittings, wiring, accessories and trailer components unless separately covered.
 

8. Liability, Assumption of Risk & Indemnity

The purchaser acknowledges that machinery and marine equipment may be inherently dangerous if not used correctly. The purchaser agrees to operate goods in accordance with manufacturer instructions, ensure operators are trained, use appropriate safety equipment, and maintain goods properly. Wild Imports is not liable for injury, death or damage arising from misuse, improper operation, modification, failure to maintain, overloading or use outside intended design. The purchaser indemnifies Wild Imports against claims, damages, losses, legal costs or liabilities arising from misuse or breach of these Terms.
 

9. Limitation of Liability

To the maximum extent permitted by law, Wild Imports’ liability is limited to repair, replacement or refund of the product supplied. Wild Imports is not liable for indirect, consequential, commercial or economic loss including loss of income, downtime, hire costs or business interruption.
 

10. Returns & Change of Mind

Change-of-mind returns may be accepted within 7 days for unused standard items in original packaging. Return freight is the purchaser’s responsibility unless the product is confirmed faulty. Custom or special-order items are non-refundable unless required under Australian Consumer Law.
 

11. Electronic Acceptance & Communication

These Terms may be provided electronically, including by email or website publication. Acceptance of a quote, payment of a deposit, full payment, electronic confirmation, or collection of goods constitutes acceptance of these Terms. Electronic communication satisfies any requirement for written notice under these Terms.
 

12. Signed Handover Acknowledgment

Upon collection or delivery, the purchaser may be required to sign a handover acknowledgment confirming the goods were inspected and accepted in satisfactory condition, safety instructions were provided, and responsibility for safe operation is accepted. Failure to sign does not invalidate these Terms where goods are accepted.
 

13. Australian Consumer Law

Nothing in these Terms excludes rights under the Australian Consumer Law. Customers are entitled to remedies for major failures and other rights that cannot be excluded by law.
 

14. Governing Law

These Terms are governed by the laws of Tasmania, Australia.
